CREATOR PROGRAM
Scentito Creator Terms
Effective Date: August 13, 2026
These Creator Terms ("Terms") govern your participation in the Scentito Creator Program ("Creator Program") operated by Scentito ("Scentito," "we," "us," or "our"). By creating a creator account and accepting these Terms, you agree to the following.
1. The Creator Program
The Scentito Creator Program allows approved creators to create and maintain a personalized fragrance storefront on Scentito.
Creators may select eligible fragrances from the Scentito catalog to feature in their storefront and may share their storefront with their audience.
Scentito operates the commerce platform and handles customer transactions, payment processing, order fulfillment, customer service, returns, and other retail operations associated with purchases made through Scentito.
Participation in the Creator Program is non-exclusive. Unless otherwise agreed in writing, you are free to work with other brands, retailers, affiliate programs, and platforms.
There is no minimum sales requirement or required posting schedule.
2. Creator Earnings
Creators earn 30% of Gross Profit on eligible completed purchases attributed to their Scentito storefront or other creator attribution methods recognized by Scentito.
For purposes of the Creator Program:
Gross Profit = Net Product Revenue − Product Cost
Net Product Revenue means the amount Scentito receives for the product after applicable discounts, refunds, cancellations, and similar adjustments. Sales taxes, shipping charges, tips, and other amounts not representing product revenue are excluded.
Product Cost means Scentito's cost to acquire the product sold.
Scentito does not deduct general business overhead, marketing expenses, payroll, website expenses, or similar operating expenses when calculating Gross Profit.
Example:
- Product sells for $200
- Scentito's product cost is $140
- Gross Profit is $60
- Creator earns 30% of $60 = $18
Earnings displayed in a creator dashboard before the applicable clearance period has ended are considered pending and are not yet payable.
3. Attribution
A purchase must be attributable to your Scentito storefront, creator link, creator code, or another attribution method recognized by Scentito to qualify for creator earnings.
Scentito's transaction records will be used to determine eligible sales and calculate creator earnings.
Transactions resulting from fraud, manipulation, self-referral abuse, duplicate transactions, payment disputes, or other attempts to improperly generate earnings are not eligible for creator compensation.
4. Returns, Cancellations, and Chargebacks
Creator earnings are calculated on completed eligible sales.
Earnings remain pending during Scentito's applicable 14-day clearance period to account for returns, cancellations, payment failures, fraud reviews, and other transaction adjustments.
If an order is returned, canceled, refunded, charged back, determined to be fraudulent, or otherwise becomes ineligible before earnings have cleared, the related creator earnings may be reduced or canceled.
If an adjustment occurs after a creator has already been paid, Scentito may deduct the applicable amount from future creator earnings.
5. Payouts
Cleared creator earnings are generally paid weekly.
Only earnings that have completed the applicable clearance period and are otherwise eligible for payment will be included in a payout.
Creators must maintain accurate payout and tax information before receiving payment.
Scentito may temporarily delay a payout when reasonably necessary to investigate suspected fraud, payment disputes, account security issues, inaccurate payment information, or violations of these Terms.
There is no fee to join the Creator Program.
6. Taxes and W-9 Information
Creators are responsible for taxes associated with payments they receive through the Creator Program.
Creators may be required to provide a completed Form W-9 and other information reasonably necessary for tax reporting and payment processing.
Scentito may withhold or delay payments when required tax or payment information has not been provided.
Scentito may issue applicable tax forms when required by law.
Creators are responsible for determining and satisfying their own federal, state, local, and other tax obligations.
7. Your Storefront and Content
You are responsible for the information and content you submit to Scentito, including your name, biography, profile photograph, fragrance selections, recommendations, written descriptions, photographs, videos, social media handles, and other materials ("Creator Content").
You represent that you own your Creator Content or have the necessary rights and permissions to use and provide it to Scentito.
Your Creator Content must not infringe another person's intellectual property, privacy, publicity, or other rights.
8. Permission to Use Creator Content
You retain ownership of your Creator Content.
By submitting Creator Content to Scentito, you grant Scentito a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, resize, distribute, and otherwise use that content as reasonably necessary to:
- operate and display your Scentito storefront;
- operate and promote the Creator Program;
- identify you as a Scentito creator;
- promote your storefront and the products you have selected; and
- operate Scentito's website, applications, social media, email, and related marketing channels.
This permission does not transfer ownership of your Creator Content to Scentito.
If you leave the Creator Program, Scentito will stop using your Creator Content in new promotional materials within a reasonable period, except where continued use is reasonably necessary for historical records, previously published materials, legal compliance, or content that cannot reasonably be withdrawn.
9. Creator Promotion and Disclosures
You decide whether, when, and how often to promote your Scentito storefront, unless you separately agree to a specific campaign.
There is no required posting frequency under these Terms.
When promoting products or your Scentito storefront, you are responsible for complying with applicable advertising, endorsement, and disclosure requirements, including clearly disclosing your financial relationship with Scentito when required.
Creators may not make false or misleading claims about Scentito, fragrances sold through Scentito, pricing, product availability, earnings, or the Creator Program.
10. Prohibited Conduct
Creators may not:
- generate fraudulent or artificial purchases;
- manipulate attribution or tracking systems;
- misrepresent their identity, audience, or relationship with Scentito;
- make false or misleading product or earnings claims;
- use Scentito for unlawful purposes;
- infringe intellectual property or other third-party rights;
- interfere with Scentito's website, systems, security, or operations;
- impersonate Scentito or claim authority to bind Scentito;
- purchase advertising using Scentito trademarks or confusingly similar terms without permission; or
- engage in conduct reasonably likely to harm customers, creators, Scentito, or the integrity of the Creator Program.
11. Independent Relationship
Participation in the Creator Program does not create an employment relationship, partnership, joint venture, franchise, agency, or fiduciary relationship between you and Scentito.
You participate as an independent creator.
You do not have authority to enter into agreements, make commitments, incur obligations, or make representations on behalf of Scentito.
12. Account Closure and Termination
You may stop participating in the Creator Program and request closure of your creator account at any time.
Scentito may suspend or terminate a creator account for fraud, abuse, violation of these Terms, legal or regulatory reasons, security concerns, or conduct that materially harms Scentito, its customers, or the Creator Program.
Scentito may also discontinue the Creator Program or a creator's participation upon reasonable notice where practicable.
Valid cleared earnings earned before termination remain payable, subject to returns, refunds, chargebacks, fraud reviews, tax requirements, and other adjustments permitted by these Terms.
13. Changes to the Creator Program
Scentito may modify the Creator Program, including available features, eligible products, attribution methods, payout processes, or compensation structure.
Changes will apply prospectively unless otherwise required by law.
If we make a material change to these Terms or creator compensation, we will provide reasonable notice through the creator account, email, website, or another appropriate method.
When required, creators may be asked to accept updated Terms before continuing to participate.
14. Availability and Program Changes
Scentito does not guarantee that any particular fragrance, brand, price, supplier, storefront feature, or product will remain available.
Products may be added, removed, repriced, or become unavailable at any time.
Scentito also does not guarantee any minimum amount of traffic, sales, conversions, Gross Profit, or creator earnings.
15. Disclaimer
The Creator Program and related platform features are provided on an "as available" basis to the extent permitted by law.
Scentito does not guarantee uninterrupted platform availability, particular sales results, creator earnings, product availability, or continued availability of any particular program feature.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
16. Limitation of Liability
To the fullest extent permitted by applicable law, Scentito will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from participation in the Creator Program.
To the fullest extent permitted by law, Scentito's aggregate liability arising from your participation in the Creator Program will not exceed the creator earnings paid or payable to you during the six months immediately preceding the event giving rise to the claim.
These limitations do not apply where prohibited by law.
17. Indemnification
To the extent permitted by law, you agree to indemnify and hold Scentito harmless from third-party claims, damages, liabilities, and reasonable expenses arising from your Creator Content, your violation of these Terms, your violation of applicable law, or your infringement of another person's rights.
18. Governing Law
These Terms will be governed by the laws of the State of Florida, without regard to its conflict-of-law principles.
Any dispute arising from these Terms will be handled in the courts located in Port St. Lucie, St. Lucie County, Florida, unless applicable law requires otherwise.
19. Entire Agreement
These Terms, together with the Scentito Privacy Policy and any additional terms expressly agreed to between you and Scentito, constitute the agreement governing your participation in the Creator Program.
If any provision is determined to be unenforceable, the remaining provisions will remain in effect.
